Introduction This Privacy Policy applies to www.moondive.co and is issued by MOONDIVE LLC, 6060 Center Drive, 10th Floor, Los Angeles, CA 90045, United States, together with its affiliate MoonDive Private Limited, Noida, India (together, “MoonDive”, “we”, “us” or “our”). MOONDIVE LLC is the controller of personal information collected through this Website. Flint and Avodo are products built and operated by MoonDive. Each has its own privacy policy covering the information collected inside that app. This Privacy Policy covers information you provide directly to MoonDive, including through our website, our forms, and at events, even where you tell us you are interested in Flint or Avodo. We respect your privacy and are committed to protecting personal information you may provide us through the Website. We have adopted this Privacy Policy to explain what information may be collected on our Website, how we use it, who we share it with, and what rights you have. This Privacy Policy also covers personal information we collect outside the Website, including through online forms hosted on third-party form tools, and through events, trade shows and conferences we attend. Please read the section titled “Visitor Identification Technology” carefully. It explains that we use a third-party service which may identify individual business visitors to our Website, including where you have not submitted a form or otherwise contacted us.
2. Information We Collect Information you provide to us. When you complete a form, request a proposal, subscribe to our newsletter, apply for a role, book a meeting, or contact us, we collect the information you choose to give us. This typically includes your name, email address, phone number, company name, job title, and the content of your message or enquiry. We also collect personal information when you complete a form at an event or trade show, whether on your own device or on a device we provide. This typically includes your name, email address, and the products or services you told us you were interested in, and we record which event the information came from. Like most website operators, we collect information made available by your browser and our servers, such as browser type, device type, operating system, language preference, referring site, pages viewed, time spent on pages, and the date and time of each request. We may receive information about you from business data providers, visitor identification providers, event organisers, and publicly available sources such as company websites and professional networking profiles. 3. Visitor Identification Technology We use a third-party business visitor identification service, RB2B, operated by Retention.com, on this Website. This technology attempts to match visitors to our Website against the provider’s existing database in order to identify the business person or company visiting. Where a match is made, we may receive information such as your name, business email address, employer or company name, job title, professional networking profile, and the pages you viewed on our Website. This means we may learn who you are even if you have not filled in a form or otherwise contacted us. We ask first. This technology does not run unless you have given consent through our cookie banner, and we rely on your consent as the legal basis for it. You can withdraw that consent at any time using the “Cookie settings” link in the footer of every page. Where this technology operates. The provider resolves visitors located in the United States only. We additionally configure this technology so that it does not load for visitors we detect as being in the European Economic Area, the United Kingdom, Switzerland, or associated European territories. We use your device time zone, not your IP address, to make this determination, so that the check can be performed without additional processing. Why we use it. We use this information for business-to-business marketing and sales purposes: to understand which organisations are interested in our services, to prioritise our outreach, and to follow up with relevant information. We do not use it to build profiles of you in a personal capacity, and we do not knowingly use it to target consumers. How to opt out. You can ask us to stop processing information obtained through this technology, and to delete any information we already hold about you from it, at any time by emailing hello@moondive.co . We will action your request and will not require you to give a reason. You may also contact Retention.com directly to request suppression or removal from their database. Using a browser that blocks third-party tracking scripts, or an ad or tracker blocker, will also generally prevent this technology from operating.
4. Third-Party Services We Use We use the following third-party services on this Website which may collect or receive personal information. Each operates under its own privacy policy, which we encourage you to read. Google Analytics (Google LLC) — website analytics and traffic measurement. Google Tag Manager (Google LLC) — tag and script management. RB2B / Retention.com business visitor identification, as described above. Not loaded for visitors detected in the EEA, UK or Switzerland. Calendly meeting scheduling, where you choose to book a call. Hosting and infrastructure providers including Render and Microsoft Azure, which process data on our behalf in order to run the Website and our services. We may add or change providers from time to time. We will update this section when we do.
5. How We Use Your Information We use personal information to: respond to your enquiries and provide the information or services you request; prepare and send proposals; operate, maintain, secure and improve our Website and services; understand how our Website is used and measure the effectiveness of our marketing; carry out business-to-business marketing and sales outreach; process job applications; comply with our legal obligations; and establish, exercise or defend legal claims. We do not sell your personal information for money. Some privacy laws, including in California, define “sale” and “sharing” broadly enough to include certain advertising and identification practices. When you withdraw a permission, we delete the identifiers already stored on your device.
8. How We Share Your Information We share personal information only as described in this Privacy Policy. Specifically, we may share it with: Service providers and processors who perform services on our behalf, such as hosting, analytics, email delivery, scheduling and customer relationship management. They are permitted to use the information only to provide those services to us. Our affiliates , including MoonDive Private Limited in India, in order to deliver and support our services. Professional advisers such as lawyers, auditors and insurers, where necessary. Authorities and other parties where we are required to do so by law, or where necessary to protect our rights, safety, or the rights and safety of others. A buyer or successor in the event of a merger, acquisition, financing, reorganisation or sale of assets, in which case personal information may be among the assets transferred. We may publish aggregated or de-identified statistics about how visitors use our Website. Such statistics do not identify any individual, and we will not attempt to re-identify de-identified information. Advertisements appearing on our Website, if any, may be delivered by advertising partners who may set their own cookies. This Privacy Policy covers our own use of cookies and does not cover the use of cookies by advertisers.
9. International Data Transfers MoonDive operates in the United States and India, and our service providers may be located in other countries. This means your personal information may be transferred to, stored in, and processed in a country other than the one you live in, where privacy laws may differ from those in your jurisdiction. Where we transfer personal information out of the European Economic Area, the United Kingdom or Switzerland, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or an applicable adequacy decision. 10. Data Retention We keep personal information only for as long as necessary for the purposes described in this Privacy Policy, including to satisfy legal, accounting, or reporting requirements. As a general guide, we retain enquiry and marketing contact information for up to 24 months after our last meaningful interaction with you, job application information for up to 12 months after a decision unless you ask us to keep it on file, and contractual and financial records for as long as required by applicable law. When information is no longer needed, we delete it or de-identify it.
11. Security The security of your personal information is important to us. We use commercially reasonable administrative, technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse or alteration. As described above, we do not operate our visitor identification technology for visitors in these regions. India. Under the Digital Personal Data Protection Act, 2023, you have the right to access, correct, complete, update and erase your personal data, the right to grievance redressal, and the right to nominate another person to exercise your rights in the event of death or incapacity. You may raise a grievance using the contact details below. Canada. Under PIPEDA and applicable provincial law, you may access and correct your personal information and withdraw consent, subject to legal and contractual restrictions. Brazil. Under the LGPD, you have rights of confirmation, access, correction, anonymisation, portability, deletion, information about sharing, and revocation of consent. Australia, New Zealand, South Africa and other jurisdictions. You have the rights granted to you under the Australian Privacy Act, the New Zealand Privacy Act, POPIA, and other applicable local privacy laws. You may use an authorised agent to submit a request on your behalf. We may ask the agent for proof of authorisation and may ask you to verify your identity directly. Shine the Light. 14. Children’s Privacy Our Website and services are intended for businesses and professionals, and are not directed to children. We do not knowingly collect personal information from children under the age of 16, or under the age of 18 where required by applicable law such as the Indian Digital Personal Data Protection Act. If you believe a child has provided us with personal information, please contact us and we will delete it.

We have no control over, and accept no responsibility for, the content or privacy practices of any third-party site.
